Entente avec Uber: l'avocat des taxis expose ses arguments

L'avocat du front commun de l'industrie du taxi a commencé à faire valoir ses arguments, vendredi, pour tenter d'obtenir une injonction provisoire pour contrer Uber et son projet pilote conclu avec le gouvernement Couillard.
En concluant une entente avec Uber, le ministre des Transports, Laurent Lessard, a outrepassé les pouvoirs qui lui sont conférés par la loi, a estimé Me Cloutier.
Selon lui, l'entente négociée avec Uber « derrière des portes closes met à la poubelle » le système des permis de taxis visant à protéger l'industrie.
De plus, a affirmé l'avocat, le projet pilote rendu public la semaine dernière crée également un flou pour les chauffeurs d'Uber, puisque ces derniers, malgré l'entente, continuent de voir leurs véhicules saisis.
Pour obtenir une injonction provisoire comme il compte le faire, le front commun de l'industrie du taxi devra démontrer l'urgence d'obtenir son ordonnance de la part du tribunal - une ordonnance qui vise à suspendre la mise en application de l'entente. Le dossier devra ensuite être entendu sur le fond.

Allowing Uber to operate here will give people a dangerous glance into the future;

- Uber allows youngsters to make a little extra money for school and give people going to financial difficulties a temporary means to get by. This will be catastrophic to the welfare system and to the unemployment insurance fund by causing huge surpluses;
- Online technologies will cause Quebecers to go online and visit other popular sites such as Facebook, which result in more people learning English. That's detrimental;
- If the government doesn't halt competition, taxi drivers may lose the money they invested in permits. This will discourage other investors from opening restaurants, boutiques or other businesses. Who would invest here if the government didn't quash all competition once a monopoly is established?;
- Uber will allow the market to dictate the price for fares, which will lead to the dismantling of the price fixing system put in place by taxis. People will be confused as to the actual costs of transportation.

The law is clear that you need a taxi permit and specific driver's licence to dispense taxi services in Québec. Uber chose to ignore this, refused to obey our laws, chose not to collect taxes on the services it sells to the public and essentially chose to disregard our laws.
Are all these laws still necessary? Maybe not, but it is not the development of an app that should change anything in this regard.
